REAL ESTATE REGULATORY AUTHORITY (RERA)

The Real Estate Regulation Act, which comes to effect from May 2016, promises to secure the interests of home buyers and remove corruption and inefficiency from the sector.

An industry estimate suggests that about 10 lakh buyers invest every year in a house. According to Union Ministry of Housing, a total of 76,044 companies are involved in the real estate sector. It is estimated to contribute about 9 per cent of GDP.

As a house buyer, these are the seven things you need to know about real estate bill:

1. The Bill provides for mandatory registration of all projects with the Real Estate Regulatory Authority in each State. Real estate agents who intend to sell any plot, apartment or building should also register themselves with this authority.

2. It makes mandatory the disclosure of all information for registered projects like details of promoters, layout plan, land status, schedule of execution and status of various approvals.

3. It seeks to enforce the contract between the developer and buyer and act as a fast track mechanism to settle disputes.

4. Fifty per cent of the buyers’ investment has to be deposited into an escrow account that would be used only for the construction of that project.

5. The Bill prohibits a developer from changing the plan in a project unless two-thirds of the allottees have agreed for such a change.

6. Builders would be responsible for fixing structural defects for five years after transferring the property to a buyer.

7. In case builders still cause delays in transferring properties to buyers, the appellate tribunals would intervene and slap fines on them within 60 days.

Important Things to Remember Before Buying Flat/Apartment

The answer to this may differ for every person as same is dependent on many variables like personal preferences, location, budget, etc. Still there are certain things which are specific to flat purchase and are common, with no impact of your location choice like City Centre or Sub Urban and category choice like Affordable, Economical or Luxury. Over the years I have realized certain things which are important for the buyer/investor to remember before buying a flat/apartment/dwelling unit, but the 10 most important ones (according to my opinion, same may differ from readers preferences) are detailed in this post.

Legality:

It’s the most important thing to check before buying a flat. In every city there are local government bodies authorized to approve maps of any building. Buyer must check the approvals before entering into agreement or contract.

Builder Reputation:

As a buyer/investor, it’s your responsibility to check the history of Builder or Developer. By visiting old buildings constructed by the same builder, you will be in a position to decide upon the quality standards followed by the Builder. Generally, all good Developer companies maintain their complete profile in CDs. Just ask for it before buying the flat. Also by checking the past history, you can make a prediction that whether builder will provide the flat on promised possession date or not.

Competitor Work:

Before signing on dotted lines, it is very important that the buyer makes a thorough research on the work done by different builders in the same location. By seeing different projects you will be in a better position to make judgement about Quality, Facilities and Price.

Project Location (Future in Perspective):

My views are very different on this particular decision point. It is not necessary always that project on main roads have location advantage compared to the ones located on inside roads. Down the line, after some years you might realize that you have done the mistake by selecting Residential Project located on the main road because of increased traffic sound and commercial activities. Remember we are buying home not an office. While selecting any location you should check for basic facilities like grocery store, schools, hospitals, public transport, etc.

Features & Specifications:

Features are the building facilities and specifications are related to facilities and amenities provided in the flat. Every Builder/Developer gives a host of features and specifications to lure buyers. The important part in this regard is to understand which features & specifications are of real use and which are cosmetic.

Loan Facility:

Generally, all reputed builder groups are registered with leading Banks and NBFC’s to provide Home Loan facilities to their customers. Whenever any Bank or NBFC approves any project for a home loan facility, they provide APF (Approved Project Finance) number to the builder/developer. When a customer applies for a home loan, they can just quote the APF number of the project, submit their documents and get loan sanctioned. With APF facility customer is free from the stress of collecting legal documents of the project and submitting them along with his own financial papers. One good thing about the project having APF number from leading banks is that this assures you of sound legal & technical credentials of the project.

Wishlist/Priorities:

You should have a clear understanding of your wish list that what do you want? One thing we must all keep in mind is that it’s difficult to get everything we want. As a consumer, you should have absolute clarity on facilities or specifications for which we are ready to compromise and for which we are not ready to compromise. Priorities must be clearly defined and you should stick to it before making decisions.

Budget/Add-on expenses:

A consumer must write down there budget carefully. Property cost is not only the price paid to the builder but there are several add-ons which you must calculate before finalizing the property. There are add-on costs like club membership charges, parking space charges, service tax, stamp duty, registration charges, home loan processing fees, electrification charges, transformer charges, preferred location charges (PLC), etc. Sum of all these expenses is your actual property cost. I have not included maintenance deposit and charges in above list as they do not form part of property acquisition cost but are property maintenance cost. Some Builders have removed all above-mentioned charges to make it simple for their customers. Such builders only charge Basic sale price (BSP) for the property.

Area calculations:

There are 3 terms which you will come across while buying any residential flat/apartment. These are Carpet area (The area within four walls of the flat), Built up area (The area including carpet area and area occupied by walls of flat) and Super built-up area (The area including carpet area, built up an area and proportionate of common areas). Generally, builder charges on the basis of super built-up area and consumer must understand the calculation before entering into the agreement or contract.

Price:

Well, in the end, it all comes down to Price. A buyer must do a complete survey about the prices in location/area in which he is planning to buy the flat/apartment. But there are certain variables which must be kept in mind before you make a decision on the basis of price. These are facilities in the building, specifications of the flat, location, possession date, quality of construction, etc. You must understand that the most economical to buy may not be necessarily the best. A comparison should always be done between equals. Also if you like any property and you are not getting it in your budget, don’t just walk off but try to negotiate with the builder/developer as I believe that you should not let go your dream home for 5-10% difference between budget and actual cost.

UNDERSTANDING CONSTRUCTION QUALITY OF A FLAT OR VILLA

When you buy a property,you obviously want to be sure about its construction quality. New materials and technologies have improved the construction process a lot in the past few years. However, it’s not uncommon to find house owners complaining about construction and workmanship.

“An inefficient construction system beset by project delays, corruption and bureaucracy, coupled with rampant violation of building codes, has resulted in compromises with quality, making structures more susceptible to structural and safety malfunctions. This is a potential danger not only to inhabitants but also people living in the immediate surroundings”, says Sajeev Kumar, chairman and managing director, Sun Projects India (P) Ltd.

To make matters worse, all the defects might not be even visible. For instance, a lay person will not be able to find out if the building is structurally unsound. The only option he has is getting the structural and architectural details reviewed by an independent architect.
Here are a few checks that you can do on your own.

SOUND PAPERWORK

Though all developers promise ‘quality construction’, not many bother to provide the details. It is essential that the builder annexes with the (booking/purchase) agreement a schedule of amenities or specifications related to flooring, doors, windows, sanitary/electrical fittings, etc, that he will use. This ensures you are aware of what the developer is committing. However, in reality, while the type of amenities is usually mentioned in the agreement, the exact specifications and quality are not.
Putting the details on paper will also put pressure on the developer to deliver.

MEETING STANDARDS

When you buy a home, a few unannounced visits to the site will help you understand the quality of construction.

Soil Investigation:

The soil on which a building is built is very important. Its quality depends on composition, which differs from place to place. For instance, a clayrich soil will have a tendency to shrink and expand depending on moisture. All builders conduct a soil test before starting construction. You can ask for a copy of the results

Structural Design:

Making sense of the design and layout blueprints is difficult for a lay person. However, one can ask for the design created by the project’s architects and seek help from a third-party professional to make sure that everything is in place. For instance, the building should have the strength to withstand earthquakes of a certain magnitude.
“Most buildings constructed in the last five-six years can withstand mild earthquakes of around 4.0 on the Richter scale while some can withstand an earthquake of 9.0 magnitude. Much depends on how much weight it puts on the ground and the quality of steel used,” says Sajeev Kumar, chairman and managing director, Sun Projects India (P) Ltd.

Concrete Mix:

The concrete strength requirement depends on the structure’s load. Builders closely monitor the strength of the concrete mix. As it is not always possible to monitor the preparation of concrete mix on the site, ready-mix is a better alternative. Ask the builder for certification of concrete mix provided by a testing laboratory.

Wall Thickness:

Builders should mention the width of the walls in layout plans and booking/purchase agreements. Visiting the site while the construction is on to check that the builder is adhering to the original plan?

Fixtures:

When developers promise certain fixtures and finishings, it is assumed that they will be of satisfactory quality. It’s a wrong approach. One must always check if bathroom fittings, wires, electrical fittings, etc, have been certified by the Bureau of Indian Standards.

Finishing:

Once the unit is ready, the quality of plaster, tiles, marbles and paints should be visible to the naked eye. If you have any doubt, ask the builder about the brands used. The use of poor-quality paints and tiles means you will have to replace them early.

THIRD-PARTY CERTIFICATIONS

Since it is not possible for a buyer to check all the aspects of construction, he can avail of the services of independent auditors. .

“A proactive measure such as a ‘third-party audit’ can be extremely beneficial as it provides a safeguard against unpleasant surprises. In India, consumers can approach auditors registered with the Quality Council of India for an inspection to determine if materials used in the construction meet all safety norms,” says Sajeev Kumar of Sun Projects India (P) Ltd.

An independent audit can be expensive, but asking your builder to hire an inspection agency for continuous quality certifications and audits will not cost you anything. Many reputed builders have already started seeking certifications such as the CIDC-CQRA quality certification, an initiative of Durocrete Construction Quality Rating Agency and the Construction Industry Development Council, promoted by the Planning Commission.

Whether you do it yourself, seek services of a professional or rely on third-party audit certifications, be alert about the quality of the property being delivered to you.
